The State hired independent auditors, Wiss & Co. of Livingston, NJ, note in the April 30th report that the City's planning board attorney, Jack Serpico, should not be collecting a pension from the city and should not be on the payroll, but paid instead through a professional services contract.
"Effective January 1, 2008, any professional performing services under a professional service contract cannot be a member of the Public Employees Retirement System or the Defined Contribution Retirement Program," states the report. During 2008, Serpico received a retainer paid through payroll, was enrolled in the Public Employees Retirement System and was paid approximately $58,700 through a professional services contract with the City.
