Saving Asbury: Heating Plant As Contemporary Art Museum
According to the NYTimes, Mrs. Lipson ran aground with Mottola when she compared AP to a successful project in North Adams, Mass., where there was blight and high crime. Mottola bristled. Too bad Mrs. Lipson didn't consider first the plethora of parking lots in AP. As the wife of a parking magnate, she may have found common ground there.

Rumors will no doubt fly about the details of the plan. Hopefully having the actual agreement will eliminate a lot of time-wasting false impressions.
One rumor that's making the rounds is that the Sunset Avenue Pavilion, which is approved for demolition, will become a parking lot. Check the files yourself to see if there is a reference on future use for this site. Regardless, the prospect of pouring a parking lot east of Ocean Avenue seems a clear point for public comment pro or con.
Note: this contract becomes binding on May 19th, when the council votes. The clock is ticking... We'll do our best by taking comments at AsburyRadio@aol.com and posting them here to expedite a discussion. (Our civil behavior policy will be observed.) John Loffredo – can’t disagree w/ what George says because you know where I stand, I got an email past week, saying we shd allow dogs all the time, but I hv to thnk that where are we going to go w/ this and what about the enforcement/ when I’m sitting in Stella Marina and two little dogs are peeing on bdwlk I don’t like that. Even the bicycles, but not going to raise that now/ has to come a pt where cops can’t handle it…hv to ask how we’re going to deal w/ all of it.
SH – Ocean Grove has it allowed same dates we have. Don’t blame the dogs, irresponsible owners, yes, but they should be charged fines. Raise license fee fine. Chk for licensing even in our own neighborhoods.
Mayor – in my never ending search for alternate revenue certainly agree hav to revisit licensing and attn getting fines, sure shd lk at that, proper enforcement/ came across some dog owners who wd’ve kept right on going / one town used crossing guards during off hrs, identify dogs and licenses, increased rev in their town 50%.
TR- mst dog owners pk up after their dogs, I hav 3 and pick up after them. That’s why we have dog stations [note – we need more of them.] really comes down to dogs going to dump when they need to dump, it’s up to people to pick it up.

Current Waterfront Redeveloper Agreements
One point I've noticed is that the items for subsequent agreements leave quite a large swath of possibilities (see earlier post), which may be of import to residents here, as well as neighbors.
To reiterate, the city manager distinguished last night's closed deliberations as being limited to the retail business of Madison Marquette on the boardwalk and the company's residential interests in Wesley Grove. Why the retail business would not also involve iStar, which comprises a half of Madison Asbury Retail, is not clear to me.
Note: It is Asbury Radio's position that negotiations between iStar, and other waterfront contractors, with the City should be done before the public. The use of the contract negotiation exemption under the Sunshine Law we feel is an abuse and improper use of the clause, which is intended to allow bodies to plan strategy without the other side of a contract or dispute being privy to its maneuvers. In this case, only the public is left in the dark. Also, recently only the city's attorneys have been meeting with these principals and then advising the council in private. While the legal counsel may be highly qualified, they are not accountable to the public since the public did not elect or appoint them.

Council Not Expected To Vote on Agreements Tonight
Later employees, who had gathered in the chambers, said the union had advised them not to speak.
City Manager Terry Reidy said the purpose of the Marquette contract was to make an agreement with the City where none currently exists. The scope does not include issues such as approval of 16-story buildings for the Ocean Avenue lots or a condo/hotel of 25 stories. The agreement will cover two agreements, said Reidy: Madison Asbury Retail, LLC that is comprised of Asbury Partners, which is now owned by iStar Financial (SFI), and Madison Marquette, and runs the retail businesses on the boardwalk, and St. James Redevelopment LLC, the entity that purchased Wesley Grove condominiums from Charles Kushner.
Reidy said lately the only ones conferring with Madison Marquette's representatives, who include Amsel Fusco, are our attorneys Tom Hastie and Glenn Scotland, of McManimon & Scotland, in Newark. No elected officials.
Asked who was negotiating for iStar Financial, Reidy said they are "not part of this..." I asked, "Wasn't iStar present?"
Reidy said, "I'm not saying that."
The city attorney, when asked the same question, referred me to the redevelopment attorneys, who were not present in the chambers.
The council adjourned to executive session, saying they didn't expect to take any action tonight. However, no one cleared the chamber. The deputy clerk read from a statement saying action could be taken on either matter tonight following the executive session. Minutes, with redacted passages as per advice of city attorneys, would become available when the reason for confidentiality has passed. When I left the lights were still on and the doors remained open.

Asbury Park's Haiti Memorial Mourns Victims & Rallies Support to Rebuild
Choirs of heavenly voices joined the chorus of charities and officials, including a congressional rep, vowing to rebuild quake-devastated Haiti last night at the Paramount Theater in Asbury Park.




Only the stone-hearted could fail to react to Marc Steiner's documentary of the journey to Haiti recently undertaken by he, Pastor Sony Augustin and Langosta Lounge co-owner Marilyn Schlossbach just last week. Steiner captured both the courage and the plight of dozens of orphans and displaced Haitian children, some wearing crisp blouses and matching ribbons in their hair despite their ravaged surroundings; roads wiped out, government buildings, churches and orphanages that had pancaked spreading a ghostly gray dust over the lush siena-colored soil.
Augustin guided the group and described for them the very different environment in which he grew up, and made it clear that the country sank into poverty after his generation and long before the quake. Schlossbach (pictured with Cindy Zipf, founder of Clean Ocean Action) spoke directly, and makeup free, to the camera about the overwhelming nature of the need, her desire to help and the reality of already juggling many obligations she had back home. (Schlossbach and her husband are opening a new restaurant, The Pope and Trinity, formerly the Mattison Park, on April 1.) And she described her amazement at the resilience of the Haitians she was meeting each day. Despite the chaos all around her, Schlossbach had already set out a priority for how she would help; she would work first to build an orphanage to help house the children, most of whom are still sleeping on the streets or in tents. Later, Schlossbach told Asbury Radio Pastor Scott Hoffman of St. Pauls United Methodist Church, who built an orphanage in Haiti prior to the quake, has agreed to operate things on the ground there, such as sheperding building supplies.
The district's Democratic Congressman, Frank Pallone (pictured with award-winning artist/educator Jean Johnson, whose APHS art students created the elephant sculpture to raise donations) pledged long term support for the country. Pallone [Correction: Pallone used to sit on the House's immigration committee. Currently he serves on the Energy & Commerce Committee.] The signficance of the Democrat's appearing with the popular symbol of the Republican Party drew laughs from bystanders.)
Tom Hayes, who directs community outreach for the NJ Natural Gas company made a brief appearance (pictured with Ellen Carroll of the Coaster, Cindi D'Onofrio, director of the AP Chamber of Commerce, and Karen Schwartz Music Director of APHS) to lend support. NJNG has a long legacy of charitable work in the City. Hayes and his wife, Regina, personally saved the home where Stephen Crane grew up, by buying and maintaining it as The Crane House. They eventually sold the house for a nominal amount to Frank D'Alessandro, the 4th Avenue home's current steward. Sadly, after Hayes had left the theater, the audience learned that one of Hayes' sons has been diagnosed with Leukemia. Asbury Radio sends its best to the Hayes family and to their son for a full recovery.
Maureen Mulligan, head of Habitat for Humanity in Asbury Park, a representative of the Red Cross, Johnson, and Eve Silver, the City's Latino and relocation specialist, joined Schlossbach on the stage. Silver performed a song about loss and hope that she wrote in Spanish, singing it a capella. (She did a beautiful job!) Mulligan said Habitat of AP plans to build two more houses in Haiti, in addition to others being built there by her parent organization.
Pastor Florival of the First French Baptist Church, AP, whose choir performed, invited the mayors of Neptune or Asbury Park to the podium. Neither mayor responded, so former Mayor Randy Bishop accepted. Bishop said unlike other disasters that seem a world away the Haiti quake has brought the tragedy right next door and rallied the Neptune and Asbury Park communities to stay with the rebuilding effort to the end.

Bidders Don't Bite on $70M Share of AP Waterfront
Note: the dateline on the Press' story was Asbury Park. Apparently the Press did not send a reporter to cover the auction yesterday. The only sources quoted were City Manager Terry Reidy and Council member James Bruno. Brian Grant, the City's engineer, and Don Sammet, the City's redevelopment director were present, but no legal counsel for the city. City officials said today that Amsel Fusco was there from Madison Marquette; two people represented iStar Financial, Samantha Garvus and Zeke Faham. It was all over in ten minutes, an official said.
No one from iStar was quoted in the Press report.
Today, the City met in private / executive session to discuss iStar.
The City held the meeting under the Sunshine Law's provision for "Contract Negotiations", an exemption mostly intended to cover deliberations by governing bodies prior to union negotiations. The reason the law exempts under this category is so that the government's opposing party won't know what strategy it intends to use. Or, for example, so arbitration principals won't know what level pay rise, let's say, the government would find acceptable.
Also in private, the City was scheduled to discuss Madison Marquette, also under "contract negotiations". It is unclear whether the City has a contract with Madison Marquette, which has an LLC with Asbury Partners.
